ZOOMR USER AGREEMENT

IMPORTANT – PLEASE READ CAREFULLY

Please read this Agreement carefully before registering / riding in the Revii App (by Joyride) or using any Zoomr vehicle (electric scooters).

By registering as a user in the Revii App and unlocking or using a Zoomr vehicle, you agree to abide by this Zoomr User Agreement (this “Agreement”), including all waivers, releases, and limitations of liability contained herein.

Zoomr operates its fleet of electric scooters (“Zoomr vehicles”) using the Revii App platform by Joyride. All riders must be approved Revii App users.

If you do not agree to all terms and conditions of this Agreement, you may not rent or use a Zoomr vehicle.

You may cancel your Revii App account at any time through the Revii App. Fees and charges are non-refundable except where required by law.

1. What This Agreement Covers

This Agreement sets out the conditions under which you may use Zoomr vehicles through the Revii App platform.

This Agreement incorporates by reference:

  • Schedule A – Rate Schedule and Subscription Plans

  • Schedule B – Privacy Policy

  • Schedule C – Trip Process and Parking Rules

When this Agreement refers to “you,” it means the registered and approved Revii App user renting a Zoomr vehicle.

When this Agreement refers to “we,” “our,” or “us,” it means Zoomr.

2. Revii App Requirement

All Zoomr vehicles are accessed exclusively through the Revii App (by Joyride).

To use Zoomr vehicles, you must:

  • Create and maintain an active Revii App account

  • Be approved by Joyride

  • Provide valid payment information in the Revii App

  • Agree to Joyride’s platform terms

  • Agree to this Zoomr User Agreement

You are a Revii App user accessing Zoomr vehicles through the Joyride platform.

3. Eligibility Criteria

You must meet and maintain the following requirements:

  • Be at least 18 years old

  • Be the legal holder of the payment method on file

  • Be physically and mentally capable of safely operating an e-scooter

  • Understand and comply with all applicable laws

  • Wear a helmet at all times while riding

  • Not allow any other person to ride using your Revii account, except as expressly permitted under the Group Ride provisions in Section 3A

  • Not allow any other person to operate a Zoomr vehicle rented under your account, except as expressly permitted under Section 3A

3A. Group Rides

Overview

Zoomr permits registered adult users (aged 18+) to organize and host group rides via the Revii app, subject to the terms of this section. All group ride participants must comply with this Agreement and all applicable laws.

Account Holders and Registered Users

All individuals who create a Zoomr / Revii App account must be at least 18 years of age. There are no exceptions to this requirement.

Group Ride Hosting

A registered user who is 18 years of age or older may act as a Group Ride Host (“Host”). A Host may organize a group ride that includes participants who are 16 or 17 years of age (“Minor Participants”), subject to the following conditions:

  • The Host must hold an active, verified Revii App account in good standing.

  • The Host must be at least 18 years old.

  • Minor Participants must be between 16 and 17 years of age (inclusive).

  • No person under the age of 16 may participate in any Zoomr group ride under any circumstances.

  • The Host must have obtained express written or documented consent from a parent or legal guardian of each Minor Participant prior to the commencement of the ride.

  • The Host must be physically present with the group for the duration of the ride.

Host Responsibilities and Liability

By initiating or hosting a group ride, the Host expressly agrees to:

  • Take full legal responsibility and liability for all Minor Participants in the group for the entire duration of the ride, including before the first scooter is unlocked and after the last scooter is returned.

  • Act in the capacity of a legal guardian for all Minor Participants during the group ride.

  • Ensure all participants—including Minor Participants—wear a properly fitted helmet at all times while riding.

  • Ensure all participants comply with all traffic laws, Zoomr rules, and this Agreement.

  • Ensure all Zoomr vehicles used by the group are returned to designated Zoomr Zones upon completion of the ride.

  • Be responsible for any and all charges, fees, fines, damages, or penalties arising from the conduct of any participant within the group, including Minor Participants.

  • Indemnify and hold harmless Zoomr, its owners, employees, contractors, partners, and affiliates from any claims, losses, or liabilities arising out of the group ride, including those caused by or involving Minor Participants.

Minor Participant Restrictions

Minor Participants (ages 16–17) may only ride as part of a supervised group ride under a Host and may not:

  • Create or hold a Revii App account in their own name.

  • Unlock, rent, or pay for a Zoomr vehicle independently.

  • Ride without the Host being physically present.

  • Ride unsupervised at any point during the group ride.

Zoomr’s Right to Refuse

Zoomr reserves the right to refuse or revoke ride access at any time, including where it has reason to believe that the Host is unable to safely supervise participants, or that any participant fails to meet the eligibility requirements of this section.

4. Zoomr Vehicles (Electric Scooters Only)

Zoomr currently operates electric scooters only.

You acknowledge:

  • Zoomr vehicles are motorized and can cause serious injury or death

  • You ride at your own risk

  • We do not provide training

  • We do not provide insurance coverage for riders

  • You are responsible for all tickets, fines, penalties, damages, and losses arising from your use

  • All Zoomr vehicles remain our property at all times

5. Zoomr Zones (Designated Pickup and Drop-Off Locations)

Zoomr vehicles must be picked up and returned to designated Zoomr Zones.

A Zoomr Zone is a clearly designated pickup and drop-off location (Zoomr branded scooter rack) established by Zoomr and identified in the Revii App.

You agree to:

  • Begin your trip within an authorized Zoomr Zone

  • End your trip only within an authorized Zoomr Zone

  • Follow all posted instructions and signage at the Zoomr Zone

Failure to properly return a Zoomr vehicle to a Zoomr Zone may result in:

  • Relocation charges

  • Administrative fees

  • Continued billing

  • Loss of riding privileges

6. Starting Your Trip

To begin your trip:

  • Download and register an account on the ‘Revii’ mobile app (by Joyride)

  • Locate an available Zoomr vehicle in the Revii App

  • Scan the QR code using the Revii app

  • Complete any required pre-ride checklist

  • Confirm payment authorization

Your Rental Period begins when the scooter unlocks in the Revii App.

7. Pre-Trip Inspection

Before riding, you must inspect the Zoomr vehicle for:

  • Brake function

  • Tire condition

  • Steering alignment

  • Frame damage

  • Lights

If you discover any defect or damage, you must report it immediately in the Revii App and must not ride the scooter.

Failure to report damage before riding may result in you being held responsible.

8. Rules of Operation

You agree that you will NOT:

  • Ride under the influence of alcohol or drugs

  • Use a phone or electronic device while riding

  • Ride with a passenger

  • Carry hazardous materials

  • Use the scooter for racing, stunts, or off-road riding

  • Use the scooter for commercial delivery or business purposes

  • Modify or tamper with the scooter

  • Leave the scooter unlocked or unsecured

You agree to:

  • Follow all traffic laws

  • Ride responsibly

  • Secure the scooter during stopovers

  • Immediately report theft, damage, or accidents

9. Maximum Rental Period

The maximum rental period is fourteen (13) hours during operating hours from 9:00 AM to 10:00 PM.

Failure to return the scooter within operating hours may result in the vehicle being considered lost or stolen, and you may be charged replacement or relocation costs.

10. Charges and Payment

All charges are processed through the Revii App payment system.

Charges may include:

  • Unlock fees

  • Per-minute usage fees

  • Subscription fees (non-renewing plans only)

  • Damage or repair costs

  • Cleaning fees

  • Relocation fees

  • Improper parking fees

  • Administrative fees

  • Traffic fines paid on your behalf

All subscription plans offered by Zoomr are non-renewing. Subscriptions expire automatically at the end of their stated duration and do not automatically renew.

You authorize Zoomr and Joyride to charge your payment method on file for all applicable charges.

11. Accidents and Emergencies

You must immediately report any accident, damage, or injury through the Revii App or to Zoomr support.

You may not repair, alter, or attempt to fix a Zoomr vehicle.

If law enforcement attends the scene of an accident, you must remain present and cooperate.

12. Lost, Stolen, or Damaged Zoomr Vehicle

You are responsible for returning the Zoomr vehicle in the same condition it was received, normal wear and tear excepted.

If you:

  • Fail to return the scooter

  • Intentionally or negligently damage it

  • Leave it unsecured

  • Improperly park it

You will be responsible for the full cost of repair or replacement, as outlined in the Rate Schedule.

13. Assumption of Risk

Riding an electric scooter involves risk of:

  • Injury

  • Serious bodily harm

  • Permanent disability

  • Death

By using a Zoomr vehicle, you assume all risks associated with riding.

Zoomr provides scooters on an “as-is” basis without warranties of safety, fitness, reliability, or uninterrupted service.

14. Limitation of Liability

To the maximum extent permitted by law:

  • Zoomr shall not be liable for indirect, incidental, consequential, or punitive damages arising from your use of Zoomr vehicles.

  • Total liability shall not exceed $500.

15. Indemnification

You agree to indemnify and hold harmless Zoomr, its owners, employees, contractors, municipal partners, and affiliates from any claims, losses, damages, fines, penalties, or legal fees arising from:

  • Your use of a Zoomr vehicle

  • Your violation of this Agreement

  • Your violation of any law

  • Any group ride you host, including the conduct of Minor Participants

16. Suspension or Termination

Zoomr may suspend or terminate your access at any time if:

  • You violate this Agreement

  • Your payment fails

  • You are involved in criminal or unsafe activity

  • You misuse Zoomr vehicles

Termination of access does not relieve you of outstanding financial obligations.

17. Changes to This Agreement

This Agreement may be updated at any time.

Continued use of Zoomr vehicles through the Revii App constitutes acceptance of any changes.

18. Self-Guided Tours and Virtual Guide

Zoomr offers optional self-guided tours through a web-based app (the "Tours App"), accessed through the Revii App. The Tours App provides maps, suggested routes, turn-by-turn directions, points of interest, and an automated virtual guide. By using the Tours App, you agree to this Agreement, including this Section 18.

18.1 Directions Are an Aid Only

The maps, routes, and turn-by-turn directions in the Tours App are provided for convenience only. They may be inaccurate, incomplete, or out of date, may not reflect current road, trail, traffic, weather, or construction conditions, and may at times direct you onto busier roads or paths that are not suitable for you. You are solely responsible for choosing a safe route, for riding lawfully and safely, and for exercising your own judgment at all times. You must follow all traffic laws and all rules in this Agreement; nothing in the Tours App overrides them.

18.2 Do Not Use the Tours App While Riding

You must not look at, hold, or interact with your device while a Zoomr vehicle is moving. Stop in a safe, legal location before reading the map, viewing a stop, or using the virtual guide. Operating a Zoomr vehicle while using an electronic device is prohibited by this Agreement and by law.

18.3 Automated Virtual Guide

The Tours App includes an automated, AI-powered virtual guide that answers questions and narrates stops. Its responses are generated automatically, may be inaccurate, incomplete, or outdated, and are provided for general information and entertainment only. They are not professional, safety, legal, medical, financial, or navigational advice, and you should independently verify anything important. Do not rely on the virtual guide for safety-critical or time-sensitive decisions.

18.4 Support

For any problem, question, billing or account matter, lost item, damage, parking issue, or safety incident relating to the Tours App or your ride, use the Revii App Support menu (Help, then "Report an Issue").

18.5 As-Is; Assumption of Risk; Liability

The Tours App, its routes, and its content are provided on an "as-is" and "as-available" basis, without warranties of any kind, and may be unavailable or interrupted due to your device, GPS signal, network, or third-party services. Your use of the Tours App is at your own risk and is subject to the Assumption of Risk (Section 13), Limitation of Liability (Section 14), and Indemnification (Section 15) provisions of this Agreement, which apply to the Tours App and the virtual guide in full.

From time to time, we may offer you the option to choose a subscription plan under your user account, on terms and conditions determined in our sole discretion. Information on available subscription plans will be posted on our website and reflected in the Rate Schedule.

If you select a subscription plan, you will be required to pay the applicable subscription fees in addition to all other applicable fees and charges set forth in the Rate Schedule.

Unused rental time from a given subscription period cannot be carried over to another subscription period. For example, if you purchase a half-day subscription and do not rent a Zoomr vehicle for that full period, you may not apply any unused time from that day to any future subscription period.

SCHEDULE B – Privacy Policy

Zoomr is an e-scooter sharing program (“Zoomr vehicles”) operated by Zoomr (referred to in this Privacy Policy as “Zoomr”, “we”, “our”, or “us”).

Our ongoing commitment to protect the privacy and confidentiality of your personal information is addressed in this Privacy Policy. This Privacy Policy forms part of the Zoomr User Agreement, and capitalized terms not defined in this Privacy Policy have the same meaning given to them in the Zoomr User Agreement.

In the event of a conflict between this Privacy Policy and the Zoomr User Agreement, the Zoomr User Agreement will prevail.

This Privacy Policy explains how we collect, use, and disclose personal information in relation to Zoomr services, including processing and administering your Zoomr account. This applies to information collected through https://www.zoomr.ca, our mobile application (Revii by Joyride), social media platforms, in-person interactions, or telephone communications.

Definition of Personal Information

“Personal information” means information about an identifiable individual, excluding business contact information.

In the context of Zoomr services, personal information may include:

  • Name, address, email address, and phone number

  • Date of birth

  • Payment information (including credit card details)

  • Government-issued identification (where required)

  • Information about your Zoomr vehicle usage, trip data, and parking activity

Personal information does not include aggregated or de-identified information from which you cannot reasonably be identified.

2. Collection of Personal Information

We may collect personal information for the following purposes:

  • To establish and verify your identity

  • To administer your Zoomr account

  • To manage Zoomr vehicle rentals and track trip activity

  • To process payments and subscription enrollments

  • To evaluate eligibility for participation in Zoomr services

  • To review payment history, address unpaid balances or issue refunds

  • To respond to incidents, damage reports, or bylaw infractions

3. How We Collect Personal Information

We typically collect personal information directly from you through:

  • Online registration forms

  • Account creation through our website or mobile app

  • Customer service interactions

Where appropriate, we may obtain limited information from third-party service providers, including:

  • Identity verification providers

  • Payment processors

  • Credit or fraud prevention services

  • Insurance providers

  • Municipal authorities for bylaw or parking matters

4. Use and Disclosure of Personal Information

We use personal information to:

  • Verify identity

  • Process rental transactions

  • Administer subscriptions

  • Communicate account updates

  • Enforce our User Agreement

  • Investigate misuse, damage, theft, or bylaw violations

  • Improve Zoomr services

  • Deliver service updates or relevant offers (where permitted by law)

  • Comply with legal obligations

To fulfill these purposes, we may share information with:

  • Employees and authorized contractors

  • Partner companies

  • Payment processors

  • Insurance providers

  • Municipal or regulatory authorities

  • Legal advisors

We may communicate with you by email, phone, text, app notifications, or mail using the contact information you provide. Calls may be recorded for quality assurance and security purposes.

We may disclose personal information when required by law or where necessary to:

  • Prevent fraud

  • Collect unpaid debts

  • Respond to legal processes

  • Address public safety concerns

5. Consent

Your knowledge and consent are required for the collection, use, and disclosure of personal information except where permitted by applicable law.

By creating a Zoomr / Revii account and using Zoomr services, you consent to the practices described in this Privacy Policy.

You may withdraw consent by contacting the Privacy Officer, subject to legal or contractual limitations. Withdrawal of consent may result in termination of your ability to use Zoomr services.

6. Limiting Collection, Use, Disclosure, and Retention

We only collect and retain personal information reasonably necessary to operate Zoomr services and fulfill legal obligations.

Information is retained only as long as required for operational, legal, or legitimate business purposes.

7. Accuracy and Correction

We strive to keep your personal information accurate and up to date.

You are responsible for notifying us of changes to your information.

You may request corrections by contacting the Privacy Officer.

8. Security and Safeguards

We protect personal information using safeguards appropriate to the sensitivity of the information, including:

  • Encrypted payment processing

  • Secure servers

  • Restricted employee access

  • Contractual protections with third-party providers

Personal information may be stored outside of Canada and may be subject to the laws of the jurisdiction in which it is stored.

10. Changes to This Privacy Policy

We reserve the right to modify this Privacy Policy from time to time. The “Last Updated” date reflects the most recent revision.

Continued use of Zoomr services constitutes acceptance of the updated Privacy Policy.

11. Website Data Collection

When you visit https://www.zoomr.ca, we may collect:

  • IP address

  • Browser type

  • Device type

  • Usage statistics

We use cookies and similar technologies to improve functionality and user experience.

By using our website, you consent to this collection and use of information.

12. Self-Guided Tours App

When you use the Self-Guided Tours app (the "Tours App"), the following additional information is collected and used solely to provide the tour experience:

  • Location. With your permission, the Tours App uses your device's GPS to show your position on the map and provide directions. Your location is processed on your device and is not stored by Zoomr. When you use the route-recovery ("guide me back") or rerouting feature, your current coordinates are sent to our third-party routing provider (OpenRouteService) solely to calculate a route back to the tour.

  • Microphone / voice. If you choose to ask the virtual guide a question by voice, the speech-to-text conversion is performed by your device's own browser (for example, Apple or Google). Zoomr does not record or store your voice.

  • Virtual guide questions. Questions you type or speak to the virtual guide are sent as text to our third-party AI provider (Anthropic), through our infrastructure provider (Cloudflare), only to generate a response. Please do not include personal or sensitive information in your questions to the guide.

  • On-device storage. The Tours App stores map tiles, your preferences, and saved street names locally on your device so it can load quickly and work with limited or no signal. The Tours App does not use accounts, advertising, or tracking cookies.

SCHEDULE C – Trip Process and Parking Rules

Parking Policies and Procedures

Certain general parking rules are set out below. Additional parking instructions may be posted within the Revii mobile app, at designated Zoomr Zones, or on our website (collectively, the “Parking Instructions”). These Parking Instructions are incorporated into and form part of this Agreement.

In the event of a conflict between this Schedule C and any posted Parking Instructions, the Parking Instructions shall govern.

Where Can I Park When Ending My Trip?

You may only end your trip within a designated Zoomr Zone at a Zoomr branded scooter rack, identified in the Revii mobile application.

You must:

  • Park your Zoomr vehicle upright

  • Secure your Zoomr vehicle and helmet to the appropriate Zoomr Zone scooter rack using the provided locks

  • Ensure it does not block sidewalks, accessibility ramps, doorways, driveways, or vehicle lanes

Failure to properly secure and park your Zoomr vehicle or helmet at a Zoomr Zone scooter rack may result in additional fees or fines as outlined in the Rate Schedule.

Where Can I Park During a Stopover?

During a stopover, you may park your Zoomr vehicle at:

  • Public bike racks

  • Suitable scooter parking infrastructure

You must use the stopover or pause function in the mobile app and secure the Zoomr vehicle appropriately using the provided cable lock for the duration of the stop.

Where Can I NOT Park?

Under no circumstances may you:

  • Block pedestrian or vehicle traffic

  • Park on private property without express permission

  • Block building entrances, ramps, or emergency access routes

  • Attach a Zoomr vehicle to unsecured or unstable structures

You are responsible for understanding and complying with applicable local bylaws.

While you may park outside of Zoomr Zones during a stopover, you may only end a trip at a Zoomr Zone scooter rack as shown in the Revii mobile app.

The system will not allow trip completion outside of an approved Zoomr Zone.
